Two Missouri Wrongful Deaths and a Serious Personal Injury on Highway 25 in Dunklin County, Missouri

Virgil and Rose Smart were fatally killed on Missouri Highway 25 on August 30, 2007 in Dunklin County, Missouri. According to the Missouri Highway Patrol, the negligent driver, Darryl Roberts, drove off the side of the road and over corrected, striking the Smart’s vehicle head on. The Smart’s passenger, Hattie Smith was seriously injured and transported by AirEvac to Elvis Presley Medical Center in Memphis, Tennessee. Virgil and Rose Smart were pronounced dead at the scene by Dunklin County, Missouri Coroner Jack Adkins and were taken to Bradshaw Funeral Home in Malden, Missouri. Darryl Roberts sustained only minor injuries and was taken to Twin Rivers Medical Center in Kennett, Missouri. Our deepest condolences go out to the families of this tragic accident.

Missouri Truck Accident Involves a Cement Truck in Laclede County, Missouri

Gene and Wilma Vaughn were seriously injured on August 31, 2007 when they were attempting to make a left turn off Missouri highway 5 in Laclede County, Missouri, when a cement truck driven by Robert Stenson overturned and struck the Vaughn’s vehicle. The cement truck then went off the right side of the roadway and the Vaughn’s vehicle traveled off the left side of the roadway and down an embankment.

Robert Stenson was taken to St. John’s Hospital in Lebanon, Missouri by a private vehicle with minor injuries. The Vaughn’s were transported by St. John’s Air Ambulance to St. John’s Hospital in Springfield, Missouri where they were both treated for serious personal injuries. It is unknown at this time if the Vaughn's have retained a Missouri injury lawyer to file a lawsuit or make an insurance claim.

Warrenton Missouri Boy Dies from Injuries Sustained in a Hit and Run Car Crash

A Warrenton, Missouri boy died this last weekend when a vehicle hit him on Highway 47 in Lincoln County, Missouri. On Tuesday, police arrested suspect Robert Gerber and he has been charged with leaving the scene of an accident, a felony. No Missouri wrongful death lawsuit has been filed to date.

St. Louis Injury Lawyer Dan Bennett Found Dead

St. Louis injury lawyer Dan Bennett, 47, was found dead in his St. Louis, Missouri home last Thursday. Co-workers say they last talked to Bennett the preceding Sunday and found it odd he did not show up for work.

There has been some speculation by some St. Louis news media that Mr. Bennett's death may be in some way linked to that of Clayton, Missouri attorney Ernest Brasier last year. However, authorities have not established any link between the two deaths beyond mere coincidence.

I personally worked with Dan Bennett for over a year at Rabbitt, Pitzer & Snodgrass in St. Louis, Missouri when I first began my legal career. Dan was a respected lawyer and a "no-nonsense" type of guy. I am deeply saddened by his death and my condolences go out to his family. At this time, the cause of Dan's death is unknown, although it was not investigated as a homicide.

The manufacturer of Simplicity baby cribs has finally recalled thousands of simplicity cribs after the first complaint to the manufacturer in 2003 fell upon deaf ears. Since 2003, simplicity baby cribs have been the cause of three infant deaths. Then, the Chicago Tribune recently covered another death, prompting the recall.

The product recall was based upon a design flaw that allows the crib rail to disengage, causing a space where an infant could get trapped. In fact, a number of small children have been reported as having been trapped in this way.

What is troublesome about this recall is that it took way too long for the manufacturer to take action. Many infants died as a result of this design flaw and the manufacturer knew about the problem, yet did nothing about it. Apparently, Simplicity cribs blamed the deaths on improper installation by the consumer.

Simplicity is making new kits available to those that have purchased defective models. It is estimated that there are more than one million Simplicity cribs affected by this recall. The affected cribs are the following models: Simplicity, Aspen 3 in 1, Aspen 4 in 1, Nursery-in-a-Box, Crib N Changer Combo, Chelsea and Pooh 4 in 1. In addition, Simplicity cribs using Graco logo are: Aspen 3 in 1, Ultra 3 in 1, Ultra 4 in 1, Ultra 5 in 1, Whitney and Trio.

Fatal Car Crash in Jackson County, Missouri on Highway 7

On August 28, 2007, Dean Gilbert was driving Southbound on Highway 7 when he swerved off the road and struck Mary Nixon's car. As Mr. Gilbert's car returned to the roadway, he hit Melissa Alaiwat's vehicle. Mary Nixon was pronounced dead at the scene by Jackson County, Missouri Coroner Larry Cridledaugh. Mr. Gilbert sustained serious personal injury and was transported by Life Flight to Research Medical Center. The driver of the third vehicle involved, Melissa Alaiwat was not injured.

It is unknown whether any of the families have retained a Missouri injury lawyer to file any lawsuit or make any insurance claims. Fatal Tractor Trailer Accident in Macon County, Missouri on US 36

On August 27, 2007, Danny Hall was tragically killed on Highway 63 in a tractor trailer accident in Macon County, Missouri. The tractor trailer, driven by Matt Engen of Dallas City, Illinois failed to notice stopped traffic and his semi struck the rear of Mr. Hall’s vehicle. The force of the tractor trailer crash caused Mr. Hall’s vehicle to run off the roadway and strike a bridge wall causing it to catch fire. The vehicle then returned to the roadway, overturned and hit the undercarriage of another tractor trailer. Mr. Hall was pronounced dead at the scene by Macon County, Missouri coroner Brian Hays. An arrest is pending for Matt Engen. Our deepest sympathy goes out to Danny Hall’s family.

Missouri Truck Crash Victim Receives 5 Million Dollars for Injuries

A Jackson County, Missouri jury awarded Delbert and Pam Sanders over Five Million dollars in damages against the operator of a tractor trailer that rear-ended the Sander's truck at the intersection of Highway 25 and Highway 60. According to the truck driver, he dropped his cell phone, reached to pick it up and then when he looked up, it was too late to stop his tractor trailer.

According to the Missouri Highway Patrol, there were no skid marks at the scene of the automobile crash, indicating the truck driver made no attempt to stop his truck. When the tractor trailer hit the truck, it burst into flames causing severe burns to Mr. Sander's arms and ears as well as a traumatic head injury.

What is significant about this Jackson County, Missouri verdict is that the Plaintiff's medical expenses were only $50,000.00. However, the Plaintiff's lawyers argued he would have future lost wages of approximately $500,000.00, even though Mr. Sanders was working at the time of the lawsuit.

Attorney Ryan Bradley Settles Missouri Car Accident for Insurance Policy Limits

St. Charles, Missouri Motorcycle Accident Injures O'Fallon, Missouri Man

An O'Fallon, Missouri man sustained moderate personal injury operating his 2006 Harley Davidson motorcycle in St. Charles, Missouri. As 56 year old Billy Gillam was attempting to merge onto Highway 79 from eastbound Interstate 70, he lost control of his motorcycle, which caused it to travel off the roadway. According to the Missouri Highway Patrol, the motorcycle struck a sign and overturned, ejecting Mr. Gillam.

Mr. Gillam was taken to St. Joseph Hospital by St. Charles, Missouri ambulance where he was treated for serious injuries. It is undetermined at this time if some object in the roadway caused Mr. Gillam to lose control of his motorcycle. If there was a foreign object in the roadway, Mr. Gillam may be entitled to Uninsured Motorist benefits under his Missouri insurance policy.

Fatal Car Accident on Route 47 in Warren County, Missouri

A serious car crash in Warren County, Missouri resulted in personal injuries to a Marthasville, Missouri mother and her five year old son Samuel and wrongful death to her two year old son, Carson. According to the Missouri Highway Patrol, on September 7, 2007, Amy Heggeman's vehicle crossed over Route 47 into oncoming traffic. Her car collided with another vehicle driven by William Menne. Menne and his passenger, Jess Nolte, were seriously injured in this Missouri car crash.

Because of their personal injuries in this Missouri car wreck, William Menne, Jess Nolte and Amy Heggeman were all taken by ambulance to St. John's Hospital in Washington, Missouri. Each of their personal injuries ranged from moderate to serious.

Amy Heggeman was later transferred to St. John's Hospital in Creve Coeur, Missouri. Her five year old son, Samuel was listed as having a serious injury and is being treated at Cardinal Glennon Children’s Hospital in St. Louis, Missouri. Two year old Carson was taken to St. John's Hospital in Washington County, Missouri where he later died from serious personal injury.

Tractor Trailer Accident on Route B in Butler County, Missouri

On August 22, 2007, Butler County, Missouri was the scene of another tractor trailer truck crash with a small vehicle. David Rush failed to stop his tractor trailer at a stop sign on Route B and crashed into Mavis Presson and his wife, forcing them them off the roadway into a utility pole. Both Mr. and Mrs. Presson were transported by ambulance to Poplar Bluff Regional Medical Center in Poplar Bluff, Missouri where they were treated for moderate personal injury.

McDonald County, Missouri Tractor Trailer Accident on Highway 59

On August 21, 2007, Jonathan Wolfe lost control of his tractor trailer rig on Highway 59 in McDonald County, Missouri when going around a curve. According to the highway patrol, his truck and trailer crossed the center line when the towed unit detached from the tractor and overturned onto Bruce Wilkins' car. Mr. Wilkins was taken to Freeman Hospital in Neosho, Missouri where he was treated for serious personal injury.

In this truck crash, it is clear the driver of the tractor trailer was traveling too fast for conditions. In addition, there may have been some problem with how the trailer was attached to the tractor unit. Two Tractor Trailers Collide on I-70 in Lafayette County, Missouri

On August 19, 2007 on I-70 in Lafayette County, Missouri, Hubert Mathis lost control of his tractor trailer due to the wet roadway and crossed the center line striking Thomas Sanchez's tractor trailer head on. Two Killed in Head on Collision on Missouri Road 15

Judy Taylor of Plevna, Missouri was driving on Missouri Road 15 in Knox County, Missouri on August 19, 2007 when her car ran off the side of the road. When she tried to pull her car back onto the road, she over corrected and crossed the center line into oncoming traffic and struck the Russell's car head on.

Sandra Russell was taken by air to University Medical Center in Columbia, Missouri where she later died from serious personal injury. Her husband, Raymond Russell was seriously injured and transported to Blessing Hospital in Quincy, Illinois. Judy Taylor was pronounced dead at the scene by Knox County, Missouri Coroner Jeffrey Doss.
